In real estate law, a Fee Simple Defeasible is an ownership interest in property that is subject to a specified condition or event. Although the owner holds a fee estate with many of the rights of fee simple ownership, the estate may be terminated if the stated condition occurs or is violated.
This type of estate is created by language in the deed that limits the duration of ownership or imposes conditions on use. If the condition is triggered, ownership may revert to the grantor or give the grantor the right to reclaim the property, depending on the specific terms of the conveyance.
