In real estate law, Lis Pendens is a legal notice recorded in the public records to indicate that a lawsuit is pending that affects title to or possession of real property. The notice serves to warn potential buyers or lenders that the property is subject to litigation.

Anyone who acquires an interest in the property after a lis pendens is recorded may be bound by the outcome of the lawsuit. As a result, a lis pendens can significantly impair a property’s marketability until the legal matter is resolved.
