Misrepresentation

by | Feb 6, 2026

In real estate, misrepresentation refers to a false or misleading statement or assertion made in connection with a property or transaction. It may involve incorrect information about a material fact or the omission of information in a way that creates a deceptive impression.

Misrepresentation can occur intentionally or unintentionally, but in either case it can affect the decisions of buyers, sellers, or lenders. When misrepresentation influences a party to enter into a transaction, it may give rise to legal liability, including claims for damages or rescission of the contract.
