Quiet Enjoyment

by | Feb 6, 2026

In real estate law, quiet enjoyment is the right of a property owner or tenant to use and occupy property without interference or disturbance of possession. This right is implied in most ownership and lease arrangements.

Quiet enjoyment protects against actions that substantially interfere with the lawful use of the property, whether by the landlord or others claiming under the landlord. If this right is violated, the affected party may have legal remedies for breach of the agreement or tenancy.
