Access Right

The right of an owner to have ingress and egress to and from owner’s property over adjoining land. This is usually in the form of an easement. For example, one property may have an access right over another property, meaning that the owner of one property has the right to use a walkway over the neighboring property. This type of easement is often called an easement appurtenant, meaning that this easement is appurtenant to ownership of the property. If the property is sold, the easement is sold with the property, since it is appurtenant to the property (aka, it is connected to it). An easement is usually either dominant or servant. The dominant easement is the one that has a right to use another property in a specific way; the servient easement is associated with the property that may be used by the property with the dominant easement.
