Encroachment

In real estate, an Encroachment occurs when a structure or improvement extends onto or over the property of another without legal authorization. Common examples include walls, fences, driveways, or portions of buildings that cross a property boundary.

Encroachments can affect property value, marketability, and the ability to convey clear title. They are often discovered through surveys and may need to be resolved through removal, boundary agreements, easements, or legal action before a property can be sold or refinanced.
