Emblements

by | Feb 4, 2026

In real estate law, Emblements are growing crops that are produced through annual cultivation, such as wheat, corn, or vegetables. Although they are attached to the land while growing, emblements are considered personal property rather than real property.

The concept of emblements is important when possession of land changes unexpectedly, such as upon the termination of a lease or the death of a landowner. In these situations, the party who planted the crops typically has the right to harvest them, recognizing the labor and investment involved in producing the crops.
