In real estate law, Eminent Domain is the power of a government entity to acquire private property for public use through a legal process known as condemnation. Public uses may include roads, schools, utilities, or other projects intended to benefit the community as a whole.
When property is taken through eminent domain, the government is required to pay the owner just compensation, which is generally based on the property’s fair market value. Property owners are entitled to due process and may challenge the amount of compensation or, in some cases, the necessity of the taking under applicable law.
